El Court of Justice of the State of São Paulo (TJSP) confirmed the conviction of youtuber Felipe Castanhari to compensate actor Marcius Melhem. Castanhari called Marcius Melhem a "scrotum" and a "persecutor who deserves prison for all the suffering he has caused" in a post on his social media. The case began in December 2020, after Piauí magazine published a report titled "What more do you want, daughter, for you to shut up?", denouncing an investigation for moral and sexual harassment against Melhem. Ecuador receives sentence against for violation of the right to freedom of expression. Twelve years after September 30, 2010, the Ecuadorian State has been condemned for having violated the right to freedom of expression of Emilio Palacio Urrutia and the El Universo Newspaper. The case dates back to the days after September 30, the date on which Ecuador experienced intense tensions in the streets and in national security due to revolts by police officers dissatisfied with the government. President Rafael Correa barricaded himself in a police station and, from there, made speeches that exacerbated the violence. Days later, Emilio Palacio wrote an opinion column criticizing the government's role and action in the face of the revolt and disorder. The Inter-American Court of Human Rights notified on December 17 of last year, the sentence in the Case of the Maya Kaqchikel Indigenous Peoples of Sumpango et al. v. Guatemala, and in which it found the State of Guatemala internationally responsible for the violation of the rights to freedom of expression, equality before the law and to participate in cultural life, to the detriment of various indigenous peoples of Guatemala (Maya Kaqchikel; Maya Achí ; and Maya Mam).
The Court's reasoning is based mainly on its assessment that the country's General Telecommunications Law, the main regulation for the sector, prevents, in practice, these indigenous communities from legally operating community radio by not facilitating access to spectrum frequencies. In the aforementioned judgment, the Court recalled that freedom of expression constitutes a cornerstone in the very existence of a democratic society and highlighted the importance of pluralism in the media within the framework of the exercise of said right.
The Court also indicated that the States are internationally obliged to establish laws and public policies that democratize access to the media and guarantee the pluralism of the information media in the different communication areas, such as the radio. Something extremely important to take into account were the reparation measures ordered, among which the State is ordered to adopt the necessary measures to allow the indigenous communities, identified as victims of this case, to freely operate their community radio stations and adapt the regulations to avoid that this situation continues in Guatemala.
